Terms and Conditions of Use
- By applying to open an account with Universal Title Searchers (Universal), you agree to abide by all the terms and conditions set out herein.
- Upon opening an account, Universal will provide you with instructions for the creation of a ‘User Profile’ (a register of User Name/s and Password/s) to enable you to register one or more staff members who are thereby authorised to access Universal’s online system and its range of information products and services.
- You acknowledge that you are liable for all fees and charges resulting from the use of Universal’s online system and its range of information products and services by all registered User Name(s) and Password(s) created on your account.
- You are able to add to and/or delete from your registered ‘User Profile’ at any time convenient to yourself and you acknowledge that you are responsible for the maintenance of your ‘User Profile’.
- You indemnify Universal, its agents and employees from any costs, fees, damage, loss, claims and liabilities arising from any use or misuse of the User Name(s) and Password(s).
- You agree to pay Universal the fees and charges as specified in its standard fee schedule as amended from time to time.
- Universal will provide a Tax Invoice in accordance with the GST Act on a weekly basis to the Customer subject to use of Universal’s services by the Customer in the relevant week.
- You agree to make full payment of Universal's Tax Invoice (including GST) within thirty (30) days of the date of the tax invoice referred to in Clause 7.
- Should your cheque or credit card payment of Universal’s account be dishonoured, you agree to reimburse Universal and acknowledge that the dishonour fee will be applied to your account.
- Universal will make every reasonable endeavour to ensure that online services are available to you during the hours that the database custodians have published availability of their services.
- You acknowledge that:
- the Victorian Land Index Proprietor Search facility cannot be made available until the original copy of a duly executed “Deed for Landata Conditions of Use” is received and registered by Universal, and
- no access to Queensland property information products can be made available until a faxed or emailed copy of the duly executed “Standard Terms” agreement is received by Universal.
- You are prohibited from:
- using any property information for other than your own internal business purposes,
- on-selling, sub-licensing, disclosing or otherwise providing property information in any form to any other person,
- altering the format, meaning or substance of any property information supplied, and
- making copies of the property information other than as reasonably required for back up purposes, provided that such copies include a proprietary notice and are secured so as not to be accessed or used by any unauthorised persons for any purpose other than back up.
- You agree that you will not use any information product provided by Universal:
- with the intention of encroaching upon the privacy of an individual and will comply with any legislation enacted by Federal or State agencies including the Privacy Act 1988 (Cth), and
- for direct marketing purposes.
- You agree that Universal shall not be held liable for any inaccuracies or errors contained in data sourced from any database through Universal's online connections.
- Force Majeure - You agree not to hold Universal liable for any delay, loss or damage (including consequential loss) caused to you directly or indirectly by the unavailability of access to Universal's online system howsoever caused.
- Universal reserves the right to vary any term or condition provided that seven (7) days notice (in writing or by email addressed to the address of the Customer provided to Universal through the account application process) of the amendment or variation is provided to the Customer.
- If any of the details provided on your application vary at any time, you must notify Universal of such variation within one week of it taking effect.
- You consent to Universal passing your company name, and contact details to any of the database custodians to which you have access, for the purpose of that organisation conducting Customer Satisfaction surveys.
- Universal undertakes to protect the confidentiality and integrity of all Customer information passed between the parties. - Termination - You agree that Universal may terminate access to its range of information products and services without notice for breach of any term or condition stated herein.
